Welcome to Speakative. By accessing or using our website at speakative.app and our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our service.

1. Description of Service

Speakative is an AI-powered IELTS Speaking practice platform. We provide simulated speaking test sessions with an AI examiner, real-time speech analysis, and detailed feedback reports. Our service is designed for educational purposes and exam preparation.

Speakative is not affiliated with, endorsed by, or officially connected to the British Council, IDP Education, Cambridge Assessment English, or IELTS. IELTS is a registered trademark of University of Cambridge ESOL, the British Council, and IDP Education Australia. Our band score estimates are approximate and should not be considered official IELTS scores.

2. Account Registration

To use our service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration. You must be at least 13 years old to create an account.

3. Credits and Billing

Credit System

Our service operates on a credit-based system. Each practice session consumes credits based on the mode selected:

Full Mock Test — 15 credits (~15 minutes)
Part 1, Part 2, or Part 3 Only — 4 credits (~4 minutes each)
Quick Practice — 5 credits (~5 minutes)

Credit Expiration

Credits are allocated monthly and expire at the end of each billing cycle. Unused credits do not roll over to the next month. This applies to all subscription tiers including Free, Starter, and Pro.

Subscription Plans

Free — 15 credits per month, basic feedback, limited session history (last 2 sessions)
Starter — 90 credits per month, full feedback with per-question analysis, 10 sessions in history
Pro — 200 credits per month, unlimited history, PDF report downloads, all features

Top-Up Credits

Starter and Pro subscribers can purchase additional credit blocks (15 credits per block) as a recurring add-on. Top-up credits follow the same monthly expiration policy.

Payments and Refunds

All payments are processed securely through Lemon Squeezy. Subscriptions renew automatically at the end of each billing cycle (monthly or annual). You may cancel your subscription at any time through the Billing page. Upon cancellation, you retain access until the end of the current billing period. Credits are non-refundable. If you experience a technical issue that causes credit loss, please contact us and we will review your case.

4. Acceptable Use

You agree not to:

Use the service for any unlawful purpose
Attempt to reverse-engineer, decompile, or extract the AI models or prompts
Share your account credentials with others
Use automated tools, bots, or scripts to access the service
Attempt to manipulate or exploit the AI examiner (prompt injection)
Upload malicious content, hate speech, or abusive language during sessions
Resell, redistribute, or commercially exploit any part of the service

5. Intellectual Property

All content on Speakative, including but not limited to text, graphics, logos, audio, AI-generated feedback, blog posts, and software, is the property of Speakative or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

Your session transcripts and feedback reports are generated for your personal use. You may share your own feedback reports but may not present AI-generated content as your own original work in academic contexts.

6. AI-Generated Content Disclaimer

Our AI examiner and feedback system are powered by artificial intelligence. While we strive for accuracy, AI-generated band scores, feedback, and suggestions are estimates and should not be relied upon as definitive assessments of your English proficiency. Results may vary and should be used as a supplementary study tool alongside other preparation methods.

7. Availability and Modifications

We strive to maintain service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time. We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms.

8. Limitation of Liability

To the maximum extent permitted by law, Speakative shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, loss of credits, inaccurate feedback, or any impact on your actual IELTS test performance. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or abuse the service. You may delete your account at any time through the Settings page. Upon deletion, all your data will be permanently removed within 30 days.

10. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
